2. Intellectual Property
All content on the site (texts, visuals, logos, layouts, structure) is protected by copyright and, where applicable, trademark law. Any reproduction or distribution without authorization is prohibited.
3. Liability
The information provided on the site is for reference only. ALBORE reserves the right to modify it at any time. The use of spearguns requires compliance with safety rules, local regulations, and best practices in the marine environment. The user remains solely responsible for their equipment and its use.
4. Terms & Conditions of Sale (TCS)
4.1. Purpose
These TCS govern the sale of handcrafted spearguns made by ALBORE, as well as any associated accessories. As most products are made to order, specifications, finishes, and lead times are detailed in the quotation.
4.2. Order & Quotation
- A detailed quotation (model, dimensions, finishes, accessories, VAT-inclusive price, estimated lead times) is provided to the client.
- The order is confirmed once the quotation is accepted and a deposit is paid (indicative example: 50 % — to be specified on the quotation).
- The remaining balance is due before shipping or upon hand delivery.
4.3. Pricing & Payment
Prices are indicated in euros including VAT (or excluding VAT where applicable) and may vary depending on options and materials. Accepted payment methods are specified in the quotation (bank transfer, etc.). Any order implies acceptance of the TCS.
4.4. Manufacturing & Delivery Time
Lead times are indicative and stated on the quotation. Delivery is carried out using the chosen method (pick-up at the workshop, carrier, etc.). Transport-related risks are covered according to the carrier’s conditions; it is the client’s responsibility to issue reservations in the event of damage.
4.5. Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized (custom-made). For standard products (if applicable), the right of withdrawal may be exercised within 14 days from receipt, under the legal conditions in force.
4.6. Legal Guarantees
- Legal guarantee of conformity (Articles L217-3 and following of the French Consumer Code) for consumer clients.
- Guarantee against hidden defects (Articles 1641 and following of the French Civil Code).
Excluded from guarantees: normal wear, impacts, lack of maintenance, unauthorized modifications, improper storage, prolonged exposure to salt without rinsing, corrosion due to abnormal use in the marine environment, incorrect band/shaft combinations, over-tension, etc.
4.7. Repairability & After-Sales Service
Wear parts (bands, dyneema, shafts…) are replaceable. The workshop provides adjustment, maintenance, and repair services. Conditions (quotation, lead times) are communicated on a case-by-case basis.
4.8. Performance
Performance (range, speed, accuracy, perceived recoil) depends on the chosen configuration (length, band diameter and stretch coefficient, shaft mass, balance, reel, line, sea conditions, shooting technique). ALBORE provides recommendations but does not guarantee identical results in all conditions.
5. Personal Data (GDPR)
Data transmitted through the contact form (name, email, message) is used solely to respond and prepare a quotation. No data is shared with third parties. You have the right to access, correct, or delete your data by writing to contact@albore-sub.com.
6. Cookies
The ALBORE website uses cookies strictly necessary for its functioning (no advertising). Anonymous traffic statistics may be implemented in the future; they will be indicated here if applicable.
7. Applicable Law
These legal notices and TCS are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority.
