ALBORE content & identity
Unless otherwise stated, the texts, photographs, illustrations, videos, graphic elements, logos, presentations, creations and content appearing on this website are protected by applicable intellectual property laws.
Any unauthorised reproduction, representation, adaptation, exploitation or distribution of all or part of these elements is prohibited, subject to the exceptions provided for by law.
Information & liability
ALBORE endeavours to provide information that is as accurate as possible. Photographs, renderings, colours, wood grain and visual representations may, however, differ from the final product, particularly due to the natural characteristics of the materials, screen displays and handcrafted production.
The essential characteristics and contractual configuration of the product are those specified at the time of the order, in the quotation or in the applicable order confirmation.
Spearfishing and the use of related equipment require compliance with applicable legislation, local regulations, safety instructions and the conditions of use of the equipment.
Scope
These Terms and Conditions of Sale apply to sales concluded by SASU CSQ under the ALBORE trading name, including spearguns, accessories and other products offered for sale.
They apply subject to the mandatory provisions of French law, particularly those applicable when the customer is acting as a consumer.
4.1 — Handcrafted and made-to-order production
Every ALBORE speargun is handcrafted to order and adapted to its owner.
The PROTEUS, AURORA, NEREUS and PELAGOS models each define their own architecture and identity, but every speargun is made according to the configuration chosen by its owner and notably features a handle shaped and fitted to their hand using the necessary information provided when the order is placed.
Dimensions, equipment, finishes and other options may also vary depending on the model and the configuration ordered.
SOGNU is a fully bespoke creation, developed from the customer's individual project and may involve a specific design extending beyond the models in the ALBORE range.
Natural materials, particularly wood, may present variations in colour, grain, texture or appearance.
These natural variations do not, in themselves, constitute a lack of conformity where they do not affect the contractually agreed characteristics, safety or normal use of the product.
4.2 — Contractual characteristics
For creations made to order, the selected characteristics, configuration, options, customisations, price and specific conditions are detailed in the quotation, order or communications used to determine the specifications accepted by the customer.
Order confirmation
5.1 — Quotation and configuration
Where a quotation is issued, it specifies, in particular, the product, its configuration, the selected options, the price and any specific terms applicable to the order.
The customer must check the information, dimensions provided and characteristics shown on the quotation or order before confirmation.
Where certain information is required for the bespoke shaping of the handle or another component, the customer agrees to provide accurate information in accordance with the instructions provided by ALBORE.
5.2 — Deposit
Where a deposit is required, its amount is specified in the quotation or at the time of the order. The order becomes binding in accordance with the confirmation terms specified therein.
5.3 — Prices
The applicable prices are those communicated to the customer before the order is confirmed.
Any options, customisations, delivery charges and other applicable costs are specified before the sale is concluded.
5.4 — Payment
Payment methods and due dates are specified at the time of the order or in the quotation.
Where payment of the balance before dispatch is required, the item will only be dispatched after receipt of the amount due.
From the workshop to delivery
6.1 — Production
For products made to order, the applicable production and delivery date or timeframe is communicated to the customer before the sale is concluded or in the corresponding contractual documents.
In the event of circumstances likely to affect this timeframe, ALBORE will inform the customer as soon as possible, without prejudice to the rights granted to consumers by law.
6.2 — Delivery charges
Delivery charges are communicated to the customer before the order is concluded.
They may depend, in particular, on the destination, dimensions, weight and shipping method.
6.3 — Transport
Orders may be dispatched from Corsica by a carrier with tracking where available.
Where the carrier is the one offered by ALBORE, the risk of loss or damage passes to the consumer when they take physical possession of the goods.
Where the consumer independently chooses a carrier other than the one offered by ALBORE, the transfer of risk takes place in accordance with the applicable legal provisions.
6.4 — Receipt
Customers are advised to inspect the external condition of the parcel upon receipt.
If visible damage is present, customers are advised to take photographs, make any appropriate reservations with the carrier and contact ALBORE promptly.
The absence of reservations at the time of delivery does not deprive consumers of the statutory warranties to which they are entitled.
6.5 — Delivery address
The customer must provide accurate and sufficiently complete delivery information.
In the event of an error attributable to the customer requiring a new shipment, the additional costs may be charged to the customer where permitted by applicable regulations.
6.6 — Collection in person
Collection in person may be arranged where this has been agreed in advance with ALBORE. The location and arrangements are determined before the product is handed over.
In the absence of an agreement for collection in person, the order will be delivered using the shipping method agreed with the customer.
6.7 — International orders
International orders may be subject to import restrictions, customs formalities, authorisations or local regulations.
ALBORE may refuse an order where the shipment, possession, import or delivery of the product is not legally permitted in the relevant destination.
Any customs duties, import taxes or local taxes applicable at destination are, where required by applicable regulations, payable by the recipient.
Bespoke, personalised & standard products
7.1 — Made-to-order ALBORE spearguns
Every ALBORE speargun is made to order according to its owner's specifications.
This personalised production includes, in particular, the selected configuration and the handle, which is shaped and fitted to the customer's hand using the necessary information provided when the order is placed.
Therefore, even when based on a model from the PROTEUS, AURORA, NEREUS or PELAGOS range, each speargun constitutes goods made to the consumer's specifications and personalised for them.
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal applicable to distance contracts cannot, in particular, be exercised in respect of goods made to the consumer's specifications or clearly personalised.
Consequently, where an ALBORE speargun is made to the customer's specifications or clearly personalised under the conditions provided for by law, it is not covered by the right of withdrawal applicable to standard products sold at a distance.
7.2 — SOGNU
SOGNU creations are entirely bespoke and designed together with the customer.
Their architecture, characteristics, finishes and customisation elements may be specifically determined for their owner.
These creations also fall within the exception applicable to goods made to the consumer's specifications or clearly personalised where the conditions laid down in Article L221-28 of the French Consumer Code are met.
7.3 — Other standard products
For standard products that are not personalised and for which the right of withdrawal legally applies, consumers generally have fourteen days from receipt of the goods to notify their decision to withdraw.
After notifying their decision, the consumer must return the product within the applicable statutory period. The direct cost of returning the goods is borne by the consumer, unless otherwise provided by law or under more favourable terms of sale.
7.4 — Cut or assembled bands
Bands specifically cut to a length requested by the customer or prepared according to an individual configuration may fall within the exception applicable to goods made to the consumer's specifications or clearly personalised.
This exclusion of the right of withdrawal does not deprive the customer of their rights in the event of a defect or lack of conformity.
7.5 — Model withdrawal form
The form below applies only to products for which a right of withdrawal legally applies.
It does not apply to ALBORE spearguns made to order or clearly personalised where the statutory exception applies.

Statutory warranties
8.1 — Statutory guarantee of conformity
Consumers benefit from the statutory guarantee of conformity under the conditions set out in Articles L217-3 et seq. of the French Consumer Code.
This guarantee is independent of any commercial warranty that may be offered.
8.2 — Warranty against hidden defects
Customers also benefit from the warranty against hidden defects in the goods sold under the conditions set out in Articles 1641 et seq. of the French Civil Code.
8.3 — Wear and use
Normal wear of a consumable component or damage resulting, in particular, from impact, improper use, lack of maintenance, unsuitable storage or an unauthorised modification does not, in itself, constitute a defect covered by a statutory warranty.
Bands, lines, Dyneema and other components subject to normal wear must be inspected and replaced when their condition requires it.
This provision cannot have the effect of excluding or limiting statutory warranties where their conditions of application are met.
8.4 — After-sales service
ALBORE offers diagnosis, adjustment, maintenance and repair services.
Depending on the cause of the issue and the nature of the work required, coverage or a quotation may be offered.
Practical arrangements are detailed on the After-Sales Service page.
Equipment performance
The behaviour of a speargun depends, in particular, on its configuration, shaft, bands, balance, installed equipment, diving conditions and the user's technique.
The recommendations provided by ALBORE are intended to offer a suitable configuration, but do not constitute a guarantee of identical range, speed, accuracy or recoil in all situations.
Any significant modification to the configuration originally intended must be carried out with due consideration for the compatibility of the various components and applicable safety rules.
A modification carried out without ALBORE's approval may alter the behaviour, balance or performance of the speargun.
Privacy
Data provided to ALBORE may be used to respond to enquiries, prepare and manage quotations and orders, manage customer relations, organise delivery, provide after-sales service and comply with applicable administrative and legal obligations.
Depending on the nature of the relationship, the data processed may include identity details, contact details, information relating to the order, customisation, delivery and communications with ALBORE.
Where certain information or measurements are provided to enable the personalised production of a product, they are used for the preparation and performance of the relevant order.
Personal data is not sold to third parties. It may nevertheless be shared with service providers whose involvement is necessary for the provision of the service, payment, hosting or delivery, to the extent necessary for their role.
Data is retained for the period necessary for the purposes for which it is processed and in accordance with applicable statutory retention obligations.
To exercise your rights under the applicable personal data regulations, you may contact: contact@albore-sub.com .
Trackers used on the website
The website may use technologies necessary for its operation as well as analytics tools.
ALBORE currently uses Google Analytics to obtain statistics relating to website traffic and usage.
Where applicable regulations require consent for the use of a tracker, such consent must be obtained before it is stored or used.
Seeking an amicable solution
In the event of an issue concerning an order or product, customers are invited to contact ALBORE so that an amicable solution can be sought as a priority.
12.1 — Consumer mediation
Following a prior written complaint to ALBORE that has not resulted in a satisfactory solution, consumers may refer the matter free of charge to the consumer mediator responsible for SASU CSQ, under the conditions provided for by applicable regulations.
12.2 — Applicable law
These terms and conditions are governed by French law, subject to any mandatory provisions that may apply to consumers.
If an amicable resolution cannot be reached, the dispute may be brought before the competent court in accordance with the applicable legal rules.
Version of these terms
Last updated: 11 October 2026.
ALBORE may amend these terms and conditions to reflect, in particular, changes to its services or applicable regulations.
The terms applicable to an order are those contractually applicable at the time the order is concluded.
